VA Supreme Court ruling showcases power of REALTORS across the state

Virginia Supreme Court sides with VAR in important proffer case

VAR has received great news regarding a Virginia Supreme Court case the VAR Strategic Funding Committee supported with Legal Action Funds.

VAR’s Strategic Funding Committee administers the Legal Action and Issues Mobilization funds to address issues, conflicts, or disputes involving property or development rights, zoning and land use issues, or other actions or policies that adversely affect the business of real estate.

At the request of the Williamsburg Area Association of REALTORS® and Home Builders Association of Virginia (HBAV), VAR filed an amicus curiae (“friend of the Court”) brief in the Virginia Supreme Court for the case Board of Supervisors of James City County, et al v. Windmill Meadows, LLC, et al.

The case centered on VAR and HBAV-supported legislation that creates flexibility regarding the payment by developers of cash proffers to localities. Cash proffers are sometimes required by local governments to offset the capital facilities costs of proposed developments. These proffers can affect the costs of homes. VAR recognized that the outcome of this case would set a precedent for all local governments authorized to impose proffers. Therefore, VAR’s Strategic Funding Committee and board of directors sprang into action.

The court sided with VAR and HBAV regarding the retroactive nature of the cash proffer law. The court also awarded attorneys’ fees to several of the developers/home builders, which will hopefully check actions by counties in the future that may impair private property and development rights.

This is a huge win that validates VAR’s position and Legal Action Fund dollars. It is also an example of how your dues positively affect the outcome of critical issues in Virginia.

FAAR server upgrade causes intermittent website and registration outages

FAAR is currently upgrading its servers which will resolve the website and registration problems that members have been experiencing.  Unfortunately, we have to go through some growing pains before we get to that point!  FAAR apologizes for the inconvenience and in the meantime, any members experiencing issues with registration can utilize FAAR’s new docs and fliers page to print a flier for a class or event and then either email it to Sarah Otto or fax it to 540-736-0301.  Thanks for your patience while we go through this process!

2014 Dues Must Be Paid by 12/31/13

2014 FAAR dues must be paid in full by December 31, 2013.  You may pay your dues online, mail a check that will arrive before the deadline, pay in person at the FAAR office, or place your payment in the night drop box.  If the office is closed when you attempt to pay your dues, please place the payment in the night dropbox located directly across the parking lot from the FAAR main entrance.  All payments collected from the dropbox upon FAAR’s reopening after the New Year’s holiday will be considered paid on-time.  All payments received after that time will be subject to a $275 reapplication fee.

If you attempt to pay your dues online and encounter any problems, please call the FAAR office.  If the office is closed, please leave a message in the general mailbox stating your name and contact information or send an email to Lori Hillard-Wehr, FAAR Membership Director, alerting her to the problem.  Please call or email as you encounter the problem so that we can ensure your payment is considered on-time.  Any members who cannot pay their dues because of errors with the FAAR website will NOT be charged the reapplication fee.  However, we must have a record of the issues either with a voicemail or with an email received prior to the deadline.  Calls and emails received in the days after the due date will be considered late payments and will be subject to the reapplication fee.

Docs and fliers added to FAAR website

We heard you loud and clear FAAR members!  You asked for important documents and fliers for classes and events to be posted to the website and we have delivered.  You can access docs and fliers in two places on the website:  under the header for News and Events and also under quick links as referenced in the image below.  On the docs and fliers page, you will find pdf copies of all classes and events, as well as Word documents that you can edit for community service events like the cereal drive.  The editable documents will begin in 2014.
